Kathmandu, May 27: The Supreme Court has ruled that the vote of confidence taken by the Chief Minister of Gandaki Province, Khagaraj Adhikari, is unconstitutional.
The joint bench of Justices Kumar Regmi and Sunil Kumar Pokhrel ruled that the Chief Minister Adhikari’s vote of confidence, which had previously promised to get the votes of 30 members in the 60-member provincial assembly, was against the constitutional provisions. With the order of the court, Chief Minister Adhikari has been relieved of his post.
Likewise, the apex court has also ordered to reinstate former Chief Minister Surendra Raj Pandey.
In a writ petition filed by Nepali Congress Parliamentary Party leader and former Chief Minister Surendra Raj Pandey on Baisakh 25, it was claimed that the vote taken by the Chief Minister Adhikari was unconstitutional.
It was claimed that the vote of confidence was obtained by counting the votes of the provincial assembly illegally. Of the 60 members in the state assembly, the Chief Minister received 30 votes. It was claimed in the writ petition that 31 votes are required to reach the majority.
