NBA asked government to appoint Chief Justice immediately

Birgunj, Feb 26: The Nepal Bar Association’s 48th central executive council’s meeting concluded here Sunday, issuing a 23-point Birgunj Declaration.

The Association, through the declaration letter, has drawn the attention of the concerned authority to immediately take forward the process of appointing Chief Justice and to appoint Justices in the High Courts.

The meeting, acknowledging that justice delivery process gets affected when judiciary functions in the leadership of acting chiefs for a long period thereby further leaving adverse impact on the appointment of the Justices in the Supreme Court and Justices in the High Courts, directs the Nepal Bar Association to draw attention of the concerned authorities towards providing full leadership in the judiciary and appoint Justices in the Supreme Court and other High Courts.

The meeting expressed its grave concern over the statement issued recently by the Justices Society bearing the intention that Justices involved with Justice Society could also run for President and Vice-President representing the Society officially thereby overlooking the constitutional jurisdiction and judicial dignity.

The meeting also asserted that the political parties should be guided by ideals, system, values and beliefs while in the current scenario, certain vested interest and compromises seem to be guiding the political parties. The meeting concluded it would contribute towards promoting democracy and institutionalizing democratic system.

Moreover, the Association has drawn attention of the political parties in the country that if the series of formation of government, reformation and dissolution is to continue, a situation is likely when there will be a serious discussion and contemplation about the democratic system.

The declaration further insisted the concerned authority to work towards modernizing the courts and equip them with technology as per the concept of e-filing system and smart court for effective justice delivery for the justice seekers.
