KATHMANDU, Dec 23: The Supreme Court has refused to issue an interim order in the writ petition filed against the dissolution of the House of Representatives.
The 12 writ petitions filed against the dissolution of the parliament were heard in the bench of Chief Justice Cholendra Shamsher JBR on Wednesday.
The bench has directed to send all the writ petitions for hearing from the Constitutional Bench. But he refused to issue an interim order to stop the dissolution of parliament. All these writ petitions will now be heard in the Constitutional Court on Friday.
Lawyers argued that Prime Minister KP Sharma Oli’s recommendation to dissolve the House of Representatives and President Bidya Devi Bhandari’s acceptance were unconstitutional. On Wednesday, Kanchan Krishna Neupane, Samrit Kharel, Lokendra KC, Gyanendra Raj Aran, Shalikram Sapkota, Kamal Bahadur Khatri, Maniram Upadhyay, Dinesh Tripathi, Anita Gautam Poudel, Deepak Rai and Tulsi Shinkhada had also filed writ petitions.
After hearing the arguments on behalf of the writ petitioners, Chief Justice JBR announced the decision to send all the writ petitions to the Constitutional Court.
“There is only one Article 76 to dissolve the House of Representatives. The Supreme Court decides how to do that,” he said.
