Kathmandu, Oct 26: A writ petition has been filed at the Supreme Court against the chairperson and three members of the probe commission formed to investigate the suppression and subsequent incidents of destruction during the Gen-Z movement.
According to Supreme Court sources, the writ seeks an interim order to prevent the commission officials from carrying out their duties. However, the petition has not yet been registered, pending further deliberation.
Advocate Bipin Dhakal filed the writ against Commission Chairperson Gauri Bahadur Karki and members Bigyan Raj Sharma and Bishweshwar Prasad Bhandari.
The writ claims that Karki and Sharma have already expressed public opinions regarding the matters under investigation, demonstrating bias and making them unfit to serve on the commission. It argues that since the officials are required to exercise judicial discretion, their prior public statements compromise their neutrality.
The court has yet to decide whether the writ will be registered or dismissed, and a discussion will be held before making that decision, the Apex court sources said.
The government had formed the commission under the leadership of former Special Court Chair Gauri Bahadur Karki to investigate the loss of lives and property that occurred after the Gen-Z movement. The commission includes former AIG Bigyan Raj Sharma and advocate Bishweshwar Prasad Bhandari, who previously worked with UN agencies. #nepal #impunity
