Former CJs of the Supreme Court: Dissolution of HoR neglected constitutional order



KATHMANDU: Four former chief justices of the Supreme Court today issued a joint statement today saying that the dissolution of the House of Representatives by Prime Minister KP Sharma Oli was exercised outside the jurisdiction and not in the constitution.

The statement said, “Article 76 of the Constitution of Nepal 2072 BS dissolves the House of Representatives by adopting a clause that does not attract the right to dissolve the House of Representatives in any case other than for that purpose.”

Former Chief Justices Anupraj Sharma, Kalyan Shrestha, Sushila Karki and Min Bahadur Rayamajhi are among those who issued the joint statement.

The fundamental norms of constitution and its direction cannot be changed on the basis of any contemporary incident and particular context, the former CJs have argued that they have the firm belief on addressing the situations on the basis of constitution and constitutionalism.
