Kathmandu, Jan 15: The Constitutional Bench of the Supreme Court (SC) has dismissed the petition filed against Arun Kumar Chaudhary, a member of House of Representatives from the Nagarik Unmukti Party (NUP).
The bench, comprising Chief Justice Prakashman Singh Raut and Justices Sapana Pradhan Malla, Kumar Regmi, Hari Prasad Phuyal, and Dr. Manoj Kumar Sharma, ruled in favor of Chaudhary, ensuring the retention of his parliamentary seat.
The court order stated, “In the absence of pursuing alternative legal remedies available through the relevant electoral officer or court, there is no basis to deem Arun Kumar Chaudhary disqualified from holding the position of Member of Parliament. Therefore, the petition is dismissed.”
The petition was rejected on the grounds that Chaudhary had other legal avenues available, such as approaching the election officer or the relevant court, before directly appealing to the Supreme Court. Chaudhary represents Kailali Constituency No. 2 in the House of Representatives.
Advocate Basanta Joshi had demanded that the decision of the election officer, who declared him eligible to be elected as a member of the House of Representatives, be annulled, and that a new election be conducted. #sc #nepal
