SC orders to seek document regarding Sandeep bail

Kathmandu, Feb 3: The Supreme Court has ordered to submit report of the order by High Court and District Court to release cricketer Sandeep Lamichhane. He was accused of a minor rape charges.

The order was issued by SC Judge Hari Phuyal.

A petition was filed in the Supreme Court demanding the annulment of the High Court’s order to release the cricketer Sandeep Lamichhane on bail pending trial.

The attorney general’s office filed a petition in the Supreme Court on January 31 demanding that cricketer Lamichhane be detained. The hearing of the petition was scheduled for today.

The Attorney General’s Office filed a petition stating that the High Court Patan order to release Lamichhane on bail was contrary to the legal system and the Supreme Court’s interpretation of detention in cases of a similar nature.

About two weeks ago, the Patan High Court released Lamichhane with a bond of Rs 20 lakh. Judges Dhrub Raj Nand and Ramesh Dhakal of Patan High Court ordered his release with conditions.

The office has requested to cancel the order of bail according to Section 73 of the Code of Criminal Procedure, 2074. Section 67 of the code provides for imprisonment for more than three years if the evidence obtained shows that a crime has been committed. According to the code, the crime of raping a girl between the ages of 16 and 18 is punishable by imprisonment for up to 12 years. The victim girl in this case is 17 years old.
