Kathmandu, May 10: The Supreme Court has refused to restore the outgoing Chief Minister of Koshi Province Kedar Karki to the post of Chief Minister.
The single bench of Justice Hari Prasad Phuyal gave the order while hearing the petition filed by the outgoing Chief Minister Karki in the Supreme Court against the appointment of Chief Minister Hikmat Karki. The bench has issued a show cause order on the writ.
On Wednesday evening, Provincial Chief Parashuram Khapung called for the formation of a new government because Kedar Karki did not resign and did not receive a vote of confidence from the provincial assembly.
Kedar Karki had filed a writ on Thursday, demanding that the decision of the provincial chief to call, the order to send correspondence and information be cancelled.
In the writ, it has been claimed that the constitution does not envisage the provision of withdrawal of support given to the government formed under sub-section 5 of Article 168 of the Constitution.
After the formation of new coalition among CPN UML, CPN Maoist Centre, and other fringe parties, the Koshi provincial coalition was also changed accordingly. The new coalition between CPN UML and CPN Maoist Centre have the clear majority in the provincial assembly.
The new coalition had proposed Hikmat Karki as the new Chief Minister.
