Supreme Court scraps public holiday on ‘People’s War Day’

Kathmandu, Dec 30: The Supreme Court has ordered to revoke the government’s controversial decision to give a public holiday on ‘People’s War Day’ which is observed on Fagun 1.

The decision to invalidate this public holiday was prompted by a writ petition filed by advocate Gyanendra Raj Aran, challenging the Council of Ministers’ decision to declare Fagun 1 as a public holiday. The division bench, consisting of Anand Mohan Bhattarai and Mahesh Sharma Poudel, quashed the decision through a certiorari order.

“Peace process and the transitional justice issues have not reached to a conclusion and a relevant bill is under consideration in the House.

The decision to announce a public holiday without discussing un the sovereign parliament is hereby nullified through a certiorari order as per the preamble of the Constitution,” it is said.

The Cabinet meeting on 12 February, 2023 chaired by Prime Minister Pushpa Kamal Dahal ‘Prachanda’ had decided to observe the ‘people’s war day’ on Fagun 1 and give a holiday.
