KATHMANDU: Speaker Agni Prasad Sapkota has said that the President does not have the right to test the vote of confidence of the Prime Minister.
This was stated by Speaker Sapkota while submitting a written reply to the writ petition filed by 146 lawmakers against the dissolution of the House of Representatives.
“After Sher Bahadur Deuba’s demand to appoint him as the Prime Minister in accordance with Article 76 (5) of the Constitution with the support of 149 members in the House of Representatives, the House is the only place to test the basis for a vote of confidence,” said Speaker Sapkota. “Therefore, even the actions of the President are unconstitutional.”
Only a total of 93 members of the House of Representatives have expressed support for Prime Minister KP Oli, the speaker Sapkota said. “Based on this fact, it is unconstitutional and immoral to claim Oli as the Prime Minister as per Article 76 (5).”
“The Prime Minister, who has publicly acknowledged that he does not have the confidence of the House of Representatives, is again unconstitutionally and morally inclined to submit to the President his claim that he has the support of the majority of the members under Article 76 (5) of the Constitution,” he said.
